This free access website(s) is intended to provide information about Silverstone Design Solutions it’s services, latest news and it’s work for a number of it’s clients, and provide contact information for Silverstone Design Solutions.

This website is designed to be a business to business website. Silverstone Design Solutions may collect and store personal identifiable information about the persons or companies who visit this website. This information may include, but is nor limited to, details such as your name, address, telephone number, fax number, company name, job title or email address. Silverstone Design Solutions may use this information to contact you or your company about our products and services from time to time. Silverstone Design Solutions does not trade, sell, rent or pass on any information about the users of this website to any third parties for marketing purposes without your express consent. You may ask Silverstone Design Solutions to delete any information about you or your company and cease any further contact with you at anytime by contacting us.

For all designed activities we own the copyright to the design and the rights to reproduce the images provided to us. We reserve the right to use any images provided to us or products /designs created by us in wider advertising campaigns in any format.

Liability
Silverstone Design Solutions accept no liability for any errors or omissions on this website and it’s liability howsoever arising in relation to the website shall exclude liability for indirect and consequential loss including loss of profits, loss of opportunity, loss of systems, loss of reputation, business interruption, loss of programmes or other data.

Payment Schedule
All invoices for are payable within thirty (30) days of receipt. A 7% + base rate annual service charge is payable on all overdue balances of payments and expenses. The right of copyright to the Client is conditioned on receipt of full payment by the Client of the Total amount and all expenses.

Late Payment
The Client shall assume responsibility for all collection of legal fees necessitated by a late payment.

Rejection/Cancellation
The client shall not unreasonably withhold acceptance of, or payment for, the project. If prior to completion of the project, the client observes any non-conformance with the design plan, the designer must be promptly notified, allowing for necessary corrections. Rejection of the completed project or cancellation during its execution by the client will result any milestone payments made prior to cancellation being retained by Silverstone Design Solutions. and the possible billing of all additional labour or expenses to date. All elements of the project must then be returned to the designer. Any usage by the client of any of those design elements will result in appropriate legal action.

Errors and Omissions
It is the clients responsibility to check proofs carefully for accuracy in all respects, ranging from spelling to technical illustrations. Silverstone Design Solutions is not liable for errors and omissions. In the event of error and the need to reprint/republish the work, the total cost incurred will be the responsibility of the client.

Images
All costs associated with image rights are the sole responsibility of the client. If budgets are set for pictures Silverstone Design Solutions will deliver to these. Silverstone Design Solutions is not liable for any errors or omissions relating to credits for pictures.

Reproduction of Work
The client assumes full reproduction rights upon payment of completed project. Silverstone Design Solutions retains personal rights to use the completed project and any preliminary designs for the purpose of design competitions, future publications on design, educational purposes and the marketing of the designer’s business. Where applicable the client will be given any necessary credit for usage of the project elements.

Modifications of the Agreement
Modifications of the Agreement must be written, except that the invoice may include, and the Client shall pay, fees or expenses that were orally authorized by the Client in order to progress promptly with the work.

Limitation of Liability
Client agrees that it shall not hold Silverstone Design Solutions liable for any incidental or consequential damages which arise from Silverstone Design Solutions’s failure to perform any aspect of the Project in a timely manner, regardless of whether such failure was caused by intentional or negligent acts or omissions of Silverstone Design Solutions or a third party. Although we aim to meet delivery time frames quoted, we cannot be held liable for any delays or any consequences of those delays.

Additional Terms & Conditions for websites
Definitions
Silverstone Design Solutions / SDS: The designer / developer
Site / website: the website requested for development by the client.
Client: Individual or organisation requesting the services of www.silverstonedesignsolutions.com
‘In writing’: correspondence by email, or letter. Sender may be required to show proof of postage in case of lost letters.

General

SDS will carry out work as requested by the client, with instructions valid in written form, email or telephone from authorised members of the client’s organisation.

Sites will be hosted on the client’s preferred host or a popular and efficient web host service chosen by SDS. SDS does not accept liability for the running of the website service, although every effort will be made to ensure the site is hosted on a fast and efficient server.

SDS will not be responsible for domain or hosting renewal unless specifically agreed in writing with the client.

SDS will maintain sole [administrator] access to the website during construction unless specifically requested by the client and agreed with SDS. [The website will be available to view during construction, but will not be linked from the website root directory.] After completion, SDS will not retain any login passwords.

SDS will not be held responsible for loss of revenue or earnings due to difficulties with the website. Adequate alternative trading arrangements should be developed by the client to ensure trading can continue in the case of the website not operating. Clients must request if they wish to include a daily site backup in their hosting plan, otherwise it will not be included. In the case of sites including a content management system with client access, the client should keep copies of text & images in case backup is required. SDS will take a copy of the website on completion of the site, and make this available to the client if necessary. However, no liability will be assumed for the accuracy or completeness of this copy, and the client should make their own arrangements to keep website copies.

SDS is not liable for virus attacks affecting the client’s website. While every effort is made to ensure a safe host account, and virus prevention measures, new attacks are being discovered all the time. SDS will make reasonable efforts to protect sites, and may take necessary action without the client’s consent to repair or protect sites. Host account and other passwords should be stored securely, and not on clients computers. No warranty can be provided for any site content aside from warranties provided by 3rd party software suppliers. Clients should make themselves aware of the terms & conditions of any host provider they agree to use.

Websites will be designed for viewing on popular browsers, such as Internet explorer, or Chrome, and where requested mobile browsers. SDS will not be held responsible for failure to display the site on other browsers.

The client will be responsible for checking any website for errors prior to going live, and notifying SDS of any errors in a reasonable time. SDS may provide, at client’s request, a test site area for the client to view any web designs which will be hidden from normal searches.

Any material provided by the client will be used on the condition that the client has ensured no copyright infringements. The client will take all responsibility for all media provided, including images, video, logos, script.

SDS will advise the client of any additional charges quoted in writing or email prior to inclusion on the website, and will only include on the website on authorisation and 50% deposit from the client. Fees for advertising on search engines must be paid in full in advance. Any quotations are valid for 1 month.

Although SDS will ensure that all widely used methods are employed to ensure good search engine rankings, SDS cannot guarantee high placements on search engines.

The website fee will be due following completion and sign off of the website by the client. Payment terms are 30 days. Failure to pay within this period may result in the website being suspended.

Websites should be completed within 6 months of start date, if there are delays not caused by SDS then the original quote may need to be reviewed.

Any complaints received by SDS will be reviewed and discussed with the client and an outcome agreed. SDS reserves the right to remove any material which is in dispute, for example of copyright until such complaint is resolved.

Privacy
Clients using data collection systems must ensure compliance with data protection legislation. SDS is not responsible for client’s data held on web servers.
